Spamming, or the sending of unsolicited e-mail in any form, without limitation, from a Smartflex Solutions server - or refering to an e-mail address or domain that is maintained by Smartflex Solutions in such an e-mail, is STRICTLY prohibited. We reserve the right to terminate any accounts involved in such activities at our discretion. Smartflex Solutions will be the sole arbiter as to what constitutes a violation of this provision.
Domain Names registered through Smartflex Solutions must follow the Uniform Domain Name Dispute Resolution Policy as approved by ICANN.
The Account Holder, as defined by the party listed in the Smartflex Solutions accounting system, shall be responsible for maintaining security of thier password. Smartflex Solutions will not change passwords to any account without satisfactory proof of identification, this may include written authorization with signature.
In the event of any legal action that includes the Account Holder, Smartflex Solutions will remain neutral and may put the account on hold until final adjudication by a court with appropriate jurisdiction.
In the event of a breach of security through the Account Holder's account, the Account Holder will be liable for any unauthorized use of the Smartflex Solutions services, including any damages resulting therefrom, until the Account Holder notifies Smartflex Solutions Customer Service department.
All services and media provided by Smartflex Solutions may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The Account Holder agrees to indemnify and hold harmless Smartflex Solutions and its employees from any claims resulting from the use of the service which damages the Account Holder or any other party. Account Holder's are not allowed to in any way make media or services available for download or distribution, or give permission to download or save images from their site for which they do not have specific permision to do so. Also prohibited are sites that promote any illegal activity or present content that may be damaging to Smartflex Solutions servers or any other server on the Internet. Links to such materials is also be prohibited. Smartflex Solutions will be the sole arbiter as to what constitutes a violation of this provision.
The Account Holder is responsible for maintaining a complete and current copy of their website content at a remote location from Smartflex Solutions. Smartflex Solutions has the right to delete all data, files, or other information in the customers web site account, if the customer's account with Smartflex Solutions is terminated, for any reason, by either Smartflex Solutions or the customer.
Smartflex Solutions will make every good faith effort to ensure that its services are available to as many Internet users as possible and that there is as little interruption of service as possible. Smartflex Solutions does not warrant that it's service will not be interrupted or error free. Use of Smartflex Solutions services is at the customers sole risk. In no circumstance will Smartflex Solutions, its employees, or its affiliates be liable for any claims, any action either direct, indirect, special, incidental, or consequential, or any damages either punitive or alleged to have resulted, including loss of profits, from the use of or inability to use Smartflex Solutions services, from service interruptions, from customer errors or problems with their Internet connectivity, from unauthorized access to Smartflex Solutions hosting services, from communication failure, from bandwidth congestion or interruptions, or from acts of God.
We reserve the right to refuse, cancel, or suspend service at our sole discretion.
Any attempt to undermine, compromise the security of, or otherwise cause harm to any Smartflex Solutions equipment or customer accounts is strictly prohibited and will result in the cancellation of the account.
